Hi,
My wife got her ILR in 2012.
Then she went to India for delivery.
And now we have a baby who is 2 months old.
Both of them are in India now.

I recently got my ILR. And i am in UK now.

Now we have to apply visa for our baby.
I am bit confused after reading in ukba.
It was mentioned that we cannot apply visa for child if we got ILR through Tier-1. is it true?

1.) What visa should be apply for baby? is it settlement or temporary visa?
can you please give any link?

2.) Should the baby apply as dependant of both or any one parent. Is there any diff?

3.) I also heard that rules changed recently for family categories. are there any changes regarding my situation?

Can some one please help?

Thanks,
Mahesh

Hi,

My case also similar. Senior member could you please help?

I am on Tier 1 visa and eligible for ILR in Feb 2013. My son was born in UK . He is on Tier 1 dependent visa and is currently in India. His current visa is valid till Nov2013. My husband is on his own Tier 1 General visa.

My Queries:

1. If I get my ILR in Feb 2013, is my son's Tier 1 dependent visa still valid?

2. Can he travel to UK before his current Tier 1 visa expires and apply for British Citizen Ship as I will have my ILR.

3. If his current Tier 1 dependent visa becomes invalid, which visa do we need to apply from India for him to come to UK?

Could you please help ?
