Hello Friends,

Thanks for your time and help in advance.

I am eligible for ILR on the basis of T1 (G).

The guidance says UKBA considers 'Gross Earnings' towards previous earnings (consecutive last 12months out of 15months).

Question

During past 3 months I have been off sick, won't my Gross Earnings as opposed to Net Sick Pay count towards Previous Earnings?

For example, total payslips will show (say I am on £35Kp.a);

(i)(a)- Gross Earnings for 3 months = £2,917pm X 3mths = £8,750

(i)(b)- Net Earnings for 3 months = £325pm X 3mths = £975

I thought (i) (a) Gross Earnings will be counted towards previous earnings because Guidance says 'Gross Earnings'. This way my points will be higher.

Is this the case? Or (i) (b) Net Earnings/Sick Pay will be counted instead, resulting in lower points : (

Thanks for your help again.

Thanks for prompt response @wpilr_nov12.

Sorry, as the nature of my query is a bit confusing, I have given an example so that I can get clarification further.

Perhaps, I didn't explain well in my query first time, therefore started fresh so that it is less confusing.

Can you help please?

Thanks in advance for your time and help.

If you are correcting or clarifying what you said in your original post, you should do so in that post itself, instead of creating a new one to avoid cluttering the forum unnecessarily.
