Hi,

I have a query regarding eligibility for my settlement.

I came to UK as a work permit holder initially for 2 years in February 2008. My assignment got extended in February 2010 for 1 year under Tier-2 Intra Company transfer. My assignment again got extended for 2 years in February 2011 under Tier-2 Intra company transfer.

Do I qualify for ILR in February'2013 based on I will complete 5 years?

Thanks in Advance......

Need precise dates however, it looks like you qualify if you fulfill all other criteria for ILR.

Dates as requested

Came to UK 28th 2008 February and started work same day. Both time extension(leave to remain) was done before existing leave expired. Based in UK throughout since 28th February'2008 apart from paid holidays.

Do I need to submit any specific documents as I came initially on work permit and then moved to Tier 2 ICT?

Issued work permit VISA on 21/02/2008 to 21/02/2010
Entry clearance in UK on 28/02/2008

Applied leave to remain under Tier-2 ICT on 08/02/2010
Resident permit issued on 24/03/2010. Valid until 07/03/2011

Applied leave to remain under Tier-2 ICT on 26/02/2011
Resident permit issued on 17/03/2011. Valid until 08/03/2013

Do I qualify for ILR on 28th February'2013?

Do I need to submit any specific documents as I came initially on work permit and then moved to Tier 2 ICT?

Please Advise...

Hi,

I got my first entry clearance date through HSMP from India as below :
Valid From : 15/04/2008
Valid Till : 15/04/2010

My first Arrival date to UK : 6th of June 2008 ( After 50 days of Entry Clearance Date)

My Next Extension - I have received Tier 1 General Visa
Visa : Tier 1 (General) Migrant
Valid From : 23/04/2010
Valid Till : 23/04/2013

So in short :

1. My first Entry clearance date was from 14th April 2008 and valid until 14th April 2010 (HSMP).
2. I came to UK on 6th of June 2008 and my qualifying period to complete 5 years will start from 6th June 2008 until 6th June 2013 ( My guess)
3. Since I can apply for ILR, 28 days before which makes that I have to Apply on 9th of May 2013.
4. But my present Tier 1 general visa expires on 23rd April which is 15 days before my applications to ILR.

My Questions :
1. Am I eligible for applying ILR. If so when I need to apply?
2. Do I need to extend my visa and apply for ILR again after 15 days?

I'm confused. Please help me.

Thanks in advance.

Shekar,
1. You are eligible for ILR. You can apply 28 days before your EC date I.e., 28 days before 15/04/2013
2. N/A

Thanks a lot for the reply.

I did go through some of the earlier links before posting for help. Actually before posting I called up UKBA on 0870 606 7766. The lady who picked up the call said that my 5 year completion is on 6th of June 2013 and I can apply before 28days for ILR ( Which is May 9th 2013). But my visa expires on 23rd April 2013. So, I need to apply for my extension first and then any days after 15 days I can apply again for ILR.

I have told her 90 days rule and then she said it's not for my scenario where I got initial 2 years visa. This 90 days rules is for 5 years visa. She confused me.

I'm going to call again and reconfirm with them. All your inputs are pretty useful to present my case.

I will post what she says again.

Thanks again.
