When Can I Appy for ILR

Hello Friends and Senior Members,

Need help on the earliest I can apply for ILR based on below:

I am on PBS Tier 1 (General) from begining.

First Visa issued: 20th Aug 2008
Arrived in UK: 10th Oct 2008
T1 (G) extension issued: 1st Sept 2011 (applied by post on 5th Aug 2011, hence the delay).
PBS Tier 1 visa valid until: 1st Sept 2013.

What is the earliest date I can apply at PEO.

a. 5th August 2013 (28 days from current T1-G expiry date)
b. 24th July 2013 (28 days from my original Visa date)

As per the current rules, my arrival on 10th October 2008 falls within 90 days period, hence I guess I need not seek an extension of T1-G before ILR.

If eligible, I would like to apply around 24th July itself as my elder son will turn into 18 years after 17th August 2013 and it will make things complex for me (as I need to apply separately as dependent and my son also need to pass LIUK test). As of now, the LIUK site does not allow you to even register if you are not 18 years old on the day of registration.

Another added complexity in my case is, my son is going to University in this September and he can pay Home Fees only if he has ILR. Hence getting an ILR in August 2013 is critical to us to avoid a loss of year for him (No way I can afford £30K per annum University fees for 4 years).

Everything makes sense.

Also you can apply on 23rd or 24th July itself.

should be 24 July.
I'm in the similar scenario, will apply 28 days before 5 years from entry clearance issued.

Ramaan66,

I will strongly suggest and advise you not to send any email or call UKBA.Experience has revealed that people who had contacted UKBA on this minor issue got more confused after that.It appears that those that attend to enquiries there are either not familiarised with the immigration rules or they lack understanding of it.You may try but i bet you ,If you call/write three different times: You are most likely to receive three different answers.

The advise given to you is perfectly in order and in line with current immigration rules.Your entry to uk was within 90days, so you are eligible to apply within 28days to your 5th year anniversary effective from the original visa date.
