Hello There,

One of my friend is applying for ILR tomorrow and bit unclear about the new rule mentioned in the ILR application.

According to him the new rule is - evidence required for the holiday/vacation spent outside UK, even if you have not crossed 180 day limit.

Now the question is - Is evidence required (is it mandatory) for all the vacations spent outside UK?

It depends on what type of visa he currently holds and what type of holidays they were.
For work permit route it is mandatory to provide reasons/evidence for all holidays outside of UK.
For Tier 1 General it is mandatory to provide reasons/evidence for compassionate leave, but it is not required to provide evidence of any other paid annual leave.

have a mix of WP / T2 (ICT) - 3yrs & T1 - 2yrs. Currently holding a T1 Gen, in that case is evidence still required? Anyways the total duration out of UK is 130 days & all of these visits were Holiday & Family visits & not any work related/ business trips, so in that case, not sure what doc can be produced as Evidence of the Reason for the visit?

In that case for the first 3 years you will need evidence for holidays even if they were simple paid holidays. Try to get a letter from your employer at that time giving the holiday periods and reasons for each holiday.
