Few Doubts reg SET(O)

Few Doubts reg SET(O)

Hi Guys

I am going for a PEO appointment at Croydon on Jan 30th with two dependants and I have some minor confusions reg some sections of SET(O) application.

Before asking any questions I will summarize my situation

1) Entered UK on 29-JAN-2008 on Work Permit visa
2) Switched to Tier 1 general in 2009 visa applied date is 27-MARCH-2009 and visa was issued on 08-May-2009.
3) Applied for Tier 1 Extension on 02-May-2012 and visa was issued on 22-Aug-2012.Current Tier 1 leave expires on 22-Aug-2014.

1) In the past 5 years I was employed except between Aug-2010 to 27-June-2011.

During this period I did not apply for any public funds as I was not eligible for them.
Will this 11 months unemployment be a problem for my ILR application.

2) Every month my company pays me my on call money in the form of bonus.So due to this my net pay keeps on changing.

What do I need to write in section 5(5.3) If so, what is your pay each month after income tax and other deductions?

Can I write the average of the total amount earned in the past 12 months??

3) On page 11 of SET(O) form section 5 do I need to fill the stuff related to SOC code, Current rate of pay etc.

I guess I don't need to fill these bits as my latest category is Tier 1. Just wanted to confirm this bit.

4) Section 6 Immigration History

I travelled to India during my Work Permit period(29-JAN-2008 to 08-May-2009) twice on vacation for the duration of 8 & 9 days.
Do I need to get any letters from my then employer reg this travel for section 6.3??

During my Tier 1 period I travelled to India thrice for vacation for the the duration of 11,14,37 days.
Do I need to submit any explanation reg these trips for section 6.3??

Can I write vacation in reason for absence column for all my above personal trips??
Overall absence in these past 5 years is 79 days which should be OK.

5) Section 11 c

Do I need to get a letter from employer??

You don't need to provide any letter as you are on Tier 1 at the moment,

Not relevant to you , only relevant to you if you are out of you for <180 in 12 months time, You don't need to submit any

Every applicant has to mention the dates with reasons for the absence <sony
Overall absence in these past 5 years is 79 days which should be OK.

5) Section 11 c

Do I need to get a letter from employer??

Not required any letter

This is my final check list of documents:-

1. Completed Set(O) form - for me & 2 dependants
2. Two Passport photos for each applicant with name written on the back in a sealed envelope

3. Section 9A: Evidence of Previous Earnings
a- Last 12 months Salary Slips
b- Last 12 months Bank statement
c- Letter from employer that I am required for the JOB & my past 12 months earnings(signed by my HR)
d- 5 Years P 60

4. Section 11: Documents
a. Current & Previous Passports for main applicant & 2 dependants
b. Life in the UK test pass notification letter for me & wife
c. Previous Tier-1(G) & Work Permit approval letters
d. Evidence of Cohabitation(2 years bank Statement(Joint account),2 years Council Tax Bills,rental agreements)
e. Marriage Certificate,Birth certificate of my daughter(Born in India)

Extra's:- PEO appointment booking letter

Please advise me if I am missing any

After reading some of the posts in this forum i was really confused about the absences letter from the employer during Work permit period.

Do I need to submit this or not??
Please advise me on this.

documents you mentioned is more than enough,

Letter from your employer is not required as currently you on are T1 G from 2009,

here is my success story, my personal exp - we have any ideas and many suggestions avail in the world but we go with best option. I was on WP for 18 months with 60 days vacation but no letter has been submitted.

Hi xps, seems photo copies not required, they haven't asked me when i went last week,
I asked CW, Can i submit photo copies, CW said: Not required any photocopies

Note that photocopies of any document you submit as evidence for your ILR application is stated as a requirement in the guidance.

While some CW's have not requested these they were certainly asked for, when I went to Croydon earlier this month. Personally I would take them with me, if I were going to Croydon, to avoid adding more time to the wait there (because the CW would then need to spend time photocopying your evidence). Especially with the large volume of applications they process at the PEO on a daily basis.

Hi Guys

Just one last question

Just now I found that my November payslip is showing 30 pence difference from the amount what was deposited in my account.

My November pay was done in parts (1950.77+379.48=2330.25)

But my pay slip shows 2,330.55
Will this cause any trouble.

Can I explain this in a covering letter.

What would you put in the covering letter? "please notice that there is a slight discrepancy of 30 p between the two"? This would be obvious to anyone looking at the two papers.

Do you know why this happened? In that case, get whoever has the right answer to include a letter if you wish.

The pay (that you are using towards your previous earnings) in the two sources of evidence you provide, must match. There have been cases where T1G extension applications have been rejected due to a mere discrepency of a penny or two. This is in cases where an explanation has not been provided and the income threshold for points not met due to the specific payslip/bank statement not being considered.

So if there is a discrepency it would be your employer that should confirm the reason and state what the actual salary paid was, so that you can claim the correct points for the correct earnings. If this is done, you should be fine.

Yes, if you don't require that months pay, that would be the easiest & best option. Note also that you don't need to include 12 months of payslips, you just need to use the number of payslips required to score the required previous earnings points.

So if you score the points you need using 8 payslips, then that's all you need to submit.

@stokbrig i did spend couple of sleep less night approx 10 to get the booking.

Write down everything before hand in a notepad as typing may lead to errors & typo's
Open multiple tabs & keep on trying.
I did use couple of tips from this page also.
