Continuous residence period.

Hi
I got my tier 1 general visa on the 17th of june 2008.
This is my last year of the 5 years.
The issue is that my extension expires on the 2nd of june 2013. Which mean I am short of the 5 years.
My question is that how can UKBA expect me to extend the visa right on 17th of june. I mean I have to apply before a week or so and that's what I did. So can I still apply for ILR ???
Secondly has the absence rule changed to 180 days in 12 consecutive month? Does that mean 180 x 5 days 5 x 12 months?
