Query about ILR and continuous employment period

Hello forum members

I have got a question about when to go my ILR extension. I am not quite sure what to consider as continuous 5year period completion.

Here are my timelines:
1) HSMP done: 15/02/2008
2) Entered UK: 26/07/2008 and left UK after 1 week (came in for interview)
3) Back to UK: 14/09/2008
4) Continuous employment since 15/09/2008 till date
5) First Tier 1 extension: 24/11/2009
6) Second Tier 1 extension: 30/04/2012

Question is do I need to have continuous employment for my 5 year period.
In other words should I consider
2) 26/07/2008 or 3) 14/09/2008 as the start of my 5 year period.

As on HSMP you are not required to have a job throughout the 5 year period, and seen you entered UK on 26/07/2008 technically your period starts from that point.

So glad I can apply at most 28 days before 26/07/2013.

So just to be clear for ILR, if you are on HSMP and Tier 1, you DONT need to have 5 years of continuous employment.
Is that a requirement only for Tier 2 then?

It is a mandatory requirement for Tier 2/WP holders. Well if they are not employed at anytime during those 5 years(apart from 60 day rule where they are allowed to change an employer)their leave becomes invalid anyway.
