I entered the UK as student in September 2005 on the basis student for Master’s degree, initially issued until January 2007. I subsequently extended my leave to remain as student to continue my studies until september 2007.

Then issues leave from September 2007 to September 2008 as part of a crossover in the transitional stages of Tier 1 post study work route being introduced. Following this I was issued with leave as a Tier 1 post study migrant from october 2008 to september 2009. I was then issued with leave as a Tier general migrant for 3 years from October 2009 to October 2012. Now I now been issued with extension for 2 years as Tier general migrant from February 2013 to February 2015.

So end the above mentioned period I would have spent a continuous residence period of 5 years here in Tier 1 General. So when comes to applying for apply for permission to settle permanently in the UK as (indefinite leave to remain (ILR)). Can I apply directly apply for settlement or I must pass a points-based assessment again?

Can someone explain me what is the rules regards to my status and how & when should apply for the settlement. All you advice would definitely help me for some clarity.

Thanks in advance for your replies. If you have any questions please do not hesitate to ask me.

Thanks
sbm

If applying for ILR as a T1G Migrant, then yes you will need to score the necessary points at the time of your ILR application (as part of the SET(O) application). See http://www.ukba.homeoffice.gov.uk/visas ... nt/points/

The following sticky thread would be a good starting point for you to understand the FAQ. Read that along with the SET(O) form and guidance published on the UKBA site to understand the specific requirements that apply to Tier 1 General Migrants applying for ILR.
