Just checked on UKBA website that minor changes will be done to work-related settlement and will be rolled out form 6th April 2013. I've gone through the statement of changes:

But the only thing i could find is this statement: "To clarify the requirements relating to absences during the qualifying period for settlement on the Tier 1 (General) route" and "Amendments are being made to the continuous residence requirement for indefinite leave to remain for Tier 1 (General), to clarify that absences from the UK must be for a specific reason."

A bit concerned coz I assumed a 180day/year absence is a standard from December last year and I am presently on a 2 week out of UK trip which gives me a total of 105 days out of UK when I apply for my ILR in September 2013.

Any ideas as to what these changes might be?? A bit annoyed about these rule changes once again and hope some senior could help me out!?

You should begin by reading whats stated in the statement of changes in conjunction with the current T1G ILR immigration rules to understand what the changes are.

Correct me if I am wrong..According to the new rule..does it mean that you have to be in employment all through out the 5 years continuous period? What if someone like me was out of job and went abroad for couple of months to look for some business prospects. Does it mean I can't apply for ILR as I never had job for couple of months in 5 years continuous stay?

NO.

You don't need to be in employment for full 5 years.

If you was not employed than a letter from yourself explaining your situation at that time will be enough .

NO.

thanks for your reply buddy...I have read the post already..but no where it talks about the documentation I can submit for my stay outside uk. I mean I was looking for some business prospects. How can I have documentation of that? Or is the letter stating that I was out for such and such date for business venture is enough? Sorry to bother you at this point of time

My friend You just need a letter from your self that you was looking for some work/business at that time.

I will again ask you to read the point no 3 in immigration rules changes.(paragraph 245d).

In brief: An official letter stating the absence reasons from either the employer (if employed) or self (if not employed or self-employed) is to be submitted for all the days away from the UK.

Glad the 180 day/ year rule is still in place.

how can a letter written by myself be official lol?? I dont understand what UKBA want to do with this letter. If I am unemployed and not exceeding 180 days in a year..why would you want to have a letter? Do you guys think there is any logic behind it..or do u think there is some dumb a** sitting there and making some BS rules

1. Use section 8.B - Other Information of form SET-O and declare in 1-2 precise lines with exact dates of travel outside of the UK during the 5 year qualifying period when you were not in any employment, that you were -
a) Not in any employment during that period
b) The absence from the UK for that period was not paid holidays

NO, nothing else is needed. No need for a personal letter

This answer is based on actual response of other successful applicants who submitted their ILR application using form SET-0 versions 04/2013 and 12/2013
