Council Tax Not Paid now applying ILR- pl advise

Hello please advise urgently. I was 8 years student and last 2 year on post study visa and doing job. As I was as student in council record , I have not paid tax, ideally I have not informed them that I am on post study visa and therefore getting letters from council tax amounting zero from last two year. Please advice me what to do as now I am going to apply for my ilr on Monday next week. Is it a fraud or problem in ilr . Should I pay two years tax first then apply_ please help me what I should do. Please share if someone had faced same situation. I am with my husband and one kid who are my dependent- will it be a problem for them to ilr- please help me .thanks

You are legally required to repay the money when you were not a student and during your time when you were a student all persons in the property must have been students or exempt. You were claiming an exemption from council tax and were not claiming public funds. However, if you do not correct the council tax issue and were found out you would likely face refusal.

Thanks for your reply. Do you mean I should return tax when I was student? I think it should be exempt . Should I mentioned in the letter that I am paying council tax now or do you think I should apply for ilr after paying tax?
Please request to other members also to share experience related with this.

No, what is being said is that during the last two years where you were not a student, you were required by law to pay council tax - unless you were exempt from paying council tax for some other reason.

If you were not exempt for any other reason, you should now make arrangements to pay what's due for those two years. And also inform your council that you are no longer a student so that they can update their records to reflect your current status.

If you do not do this, the UKBA may refuse your application on the account of council tax evasion/fraud.

Thank you ' I am going to sort this out first . Do you think any problem if I send my ilr next week and same time ask council to take my previous tax in monthly installment over a year OR first I should pay tax then send my flr application-please advice me. Please any member had same situation in past please share your experience. One more thing should I send this in covering letter?

You can try and see what they say

OR first I should pay tax then send my flr application
Not going to make any difference

One more thing should I send this in covering letter?
Not necessary and its up to you.

Providing you're going to pay it back it's not relevant. Although, one could argue you've deceived the local authority and committed fraud. However, if you inform and arrange to pay it back they'll not prosecute.
