ILR for Non EEA Partner of EEA National living in UK

I am putting this question on behalf of my friend who is EEA national and his wife is Non EEA national. Both are living in UK since last 4 years.

My question is after how many year his wife( Non EEA national) can apply for ILR.

You should be posting in the EEA forum. The spouse of a EEA national exercising treaty rights can apply for Permanent Residency (PR) after 5 years of continuous residency in the UK whilst the EEA spouse is exercising treaty rights with the right to reside.

The correct term is PR under EEA regulations which is equal to ILR under UK immigration law. Once an EEA national completes its 5 years as being a qualified person then Non-EEA partner can apply for it.

Is this the EEA national has to complete its 5 year for the eligibility of Non-EEA partner. In my fiends case, EEA national move in UK before the his non-EEA partner. His partner join him a year later. EEA nation complete his 5 year in UK but his partner spend only 4 years here in UK. Can they apply for PR for non-EEA partner now?
