Hi,
ILR denied due to speeding ticket for my friends friend.
Speeding ticket given on 2008 on international license, court fine due to that
Applied for ILR by post last year(may), decision given this April denied. As he applied for ILR during the five year period. New rule from December 2012 that is for two years on conviction spent.
Given 28 days time to appeal

The decision was correct the rules that applied prior to December 2012 considered 'spent' convictions under the Rehabilitation of Offenders Act. In such case a court fine would not be 'spent' until 5 years had lapsed. Under the new rules, a court fine would generally (unless non-recorded FPN) be a general ground for refusual for a 24 month perios (2 years). I think your 'friend' should be looking at making a new application or extension ASAP. Although, the deicison seems unfair it was correct.

The person was not lucky, the rules were different when they applied.
