ILR Eligibility

Hi,
Any suggestions on the options I have w.r.t ILR eligibility
On Tier 2 (ICT)
First Entered UK :- July 2008
Left UK :- June 2009 (Had to leave UK as my Employer has goofed up in applying for the extension of the Tier 2 VISA and I did not want to take any chances w.r.t breaking the UKBA rules)
Returned to UK on a New Tier 2 Application :- Aug 16 2009
(Again Employer goofed up in processing the Application faster although all the relevant information was available.)
Because of gap of more than 28 days, I think I would not be eligible for ILR this year.
I believe I can show evidence that there was every intention to make UK my primary residence, but because of circumstances had to return to the country of origin.
Any suggestions/ideas please
