ILR SET(O) 5 year qualifying period

Hi,
Here's my immigration history
Tier 1 General Entry Clearance stamp -> 19 Jun 2008
Date Entered UK -> 20 Jul 2008
Tier 1 Leave to Remain Valid until -> 09 Jul 2013
I have two questions with regards to my application
1) from when can I apply for ILR using SET O?
- 28 days from 19th June (EC date) (I remember there was guidance where the days between EC and Entry could be taken for qualifying period, just can't find it now); or
- 28 days from 20th July (First Entry to UK date)
2) in SET O form
7.11. how long have you lived in the UK? Years Months
Would 4 years 10 months be valid in case I can apply 28 days from EC date?

1. 28 days before 19th June 2013.
2. 4 years 11 months.

You could apply with in the 28 days window too. That's what I did 7 days before expiry of My visa. I put it as 4 years an 11 months,lived in the UK.

if I can apply from 22nd May, I'd have only completed 4 yrs, 10 months in the country. Should I say 4 years 11 months regardless?

2.you can apply, 22/05 is 28 days before. Yes you must. CW did not ask me any question. Are you intending to go for a PEO appointment??

Don't go bang on the 28th day for a PEO appointment. CW will check you Passport and the date of application.If the date is not correct she will reject your application.Like I did,you could apply during the 28 days window. I got delayed because of Last P 60 and ,Bank statement and payslip.

i'm still confused with the eligibility to go starting 22nd May, as given the circumstances, my visa is still valid on Date of Entry minus 28 days.
I'm planning to apply in person.
