Spouse ILR from tier 1 dependant

Hi All

My spouse entered UK in sep2009 as a tier 2 ict dependant. I was then granted tier 1 visa in jul 2010 and he got tier 1 dependant visa. we both extended our tier 1 status in 2012.

I recently got my ILr, on 01/05/2013 based on WP+tier2ICT +tier 1

In my application I did not include my spouse as I was not 100% sure of the outcome due to long absences.

His tier 1 dependant leave is valid till aug 2015. Can you all pls answer my queries.

1. Is his current visa status legal? Ie I'm on ILR but he is still on tier 1 dependant?

2. Can he now directly apply for ILR or does he have to apply for flr first

3. If he can apply for ILR then which form should be used? Set o or set m

4. Finally, is it enough to give just LIUK test of does he also have to pass ESOL?

5. We are planning to apply in early July for his ILR. Is there a time frame on how early his visa status should be changed to ILR or flr first, depending on the answer to ques 2 above.

Yes.

Currently, Life in the UK test is sufficient.
