Appeal withdrawl and 3c rule

Hi,

Would any one be kind enough to help me determine, when does the 3C stop applies to person stay in UK when an appeal is withdrawn?

Is the date when the letter of withdrawal is posted or is the date when the withdrawal is confirmed by AIT? I posted my withdrawal notice on 08/09/2009 and today I have confirmed with AIT what is the withdrawal date they have got in their system. And they have confirmed its 24th of September 2009.

The reason for me asking this question on this section of forum is that I am trying to determine if I have got any break in my lawful residence in last 10 years.

you need to read through the new long residence guideline 2013 which includes very helpful examples too:

I have already gone through the guidance and I could not really find answer to my question. Any one please help?

I have also noticed that they have made some major changes to guidance with regards to out of time applications.

If I withdrew my appeal on 08/09/2009 and made a new fresh application on 10/09/2009 which was granted on 14/10/2009, will this break my lawful residence? What I understand from guidance its ok to have out of time application of less then 28 days.

Yes it is correct that new guideline allows 28 days out of time application. But you need to request SAR file from ukba to exactly know as what data/record they have regarding you.
