English Language Requirement after 28th october 2013

Hi All,
Please anyone can guide me about English Language requirement.
I am going to apply for ILR in December 2013 and currently i am a tier 1 general migrant,i did my bachelor degree in pharmacy from Pakistan which is equivalent to UK bachelor degree,i have got comparability certificate from NARIC IN 2008,Is it sufficient to prove my English requirement ,i also got from university a certificate which show that medium of instruction was English for my course.
And also for my wife,she came to UK in march 2013 as tier 1 general dependent,i know she is not qualifying for ILR as she not completed 2 years,is there will be any language requirement for her.there is no proof for her to meet English language requirement.

Hi,
You have not mentioned about your absences over this 5 year period that you will complete in Dec 2013, assuming they were with in the prescribed limit you can apply for ILR in Dec 2013.
Your wife will have to apply for extension as ILR Dependent and complete 5 years stay in UK which for her will be in Mar 2018 and then apply for ILR.

Visa extended:8/12/2011
Visa expiry:31/12/2013
Total days outside uk during 5 years 120days.
Can I apply in December 2013,if yes can I apply through the same day route (premium) or I need to send my application by post until I complete 5years.

From 28 days before 31/12/2013, a PEO appointment can be made for PBS applications.

you mean that i need to take first visa extension before my current visa expired and then i can apply fo ILR in feb 2014 to complete 5 years?

No I mean you can apply for ILR from 28 days before the above date.

Same day service for PBS applicants whose case is not complicated.

One thing more,I am going to apply for wife as well she came to uk first time in March 2013,her visa going to expired 31/12/13 on the same date like me what's the option for her?(visa stamped 7/02/13)

She can extend as a
PBS dep until she qualifies. I assume you were a T1 applicant throughout your 5 years.

Yes I am tier 1 general through out 5 years,so when she will be eligible for ILR?and also please can you reply for my first question regarding English language after 28th October rules change.

When did she enter the UK and when was she given PBS dep leave?
If you met an English requirement for EC that should suffice for settlement in addition to LIUK.

Visa stamped:8/2/13
Entered uk :9/3/13
There will be any English requirement for her when applying as PBS dependent.

New rules, so she will not qualify for 5 years. No for PBS dep extension.

If she only came to the UK for the first time in 2013, eligibility would likely be 2018.
