IRL QUERY!!! URGENT!!!

Hi,I am willing to apply in July 2013 for ILR

I came to UK on 9 july 2006,on working holiday maker visa,i got visa stamped on 15 may 2006,then switched to HSMP visa on 2 feb 2008 i got hsmp visa stamped,then i applied for extension in january2010,but it was rejected so i applied for Appeal and got visa in sep-2010,now i want to apply for ILR, as i completes the 5 yrs since feb 2008-feb2013 but as my visa is valid till sep 2013 so due to fund maintenance all i thought to apply in july as per i have few doubts i want to get clear about it

-> shall i go for set (o) form or i come under any other form category?
->if i go for premium service what will be fee for me and one dependent
->do i need to maintain funds for 3 months? if yes how much for main applicant and one dependent?


->what is criteria for absence from UK in 5 years
i have crossed 180 days (stayed outside UK) in 5 years,at one instance in 2011, due to emergency (accident), i have stayed for 91 days (stayed outside UK),excluding days of travel,so what are my options ???


For my wife she joined me in aug-2009 and she was here till oct 2010 then she came back in march 2011 and went back to india in june 2011 again back to uk in nov 2011 due to her ill health she again went bck to indian aug 2012 came bck in feb 2013 can she also apply with me for ILR

-SET(O)
-See the current version of the form for fee
-There is no fund requirement for ILR
-You cannot be absent for more than 180 days in any one year, during your 5 year ILR tenure.
-Wife on dependent visa must complete 5 year to be eligible for ILR, otherwise she needs to keep extending her visa as dependent under same category she is in now.

Regarding your wife - she came back in February 2013 was her visa renewed while she stays in UK with you or did she apply for EC from India?
In case if she applies her EC from India assuming her visa expires during her stay in India after 9th July 2012 than 5 years probationary period applies and if her visa was not applied on or after that date then she will be fine for 2 years probationary period. Please explain a bit more and in the meantime read this thread:

Also, regarding your absences, it is on chances but if there are evidence for your absences then you might be ok, I am not sure though, I have read in the same forums regarding cases more than 180 days absences but I will suggest do produce all the relevant evidences and proofs for your absences outside UK. Read this forum it might not be similar to you but his case is approved recently, he has more than 260 absences but not sure though how much in one go.

Thank you so much for all your wishes and help,

as i mentioned earlier she came in to UK in Aug 2009 applied for extension in Jan 2010 wid me and got rejected so we applied for appeal and got visa stamped in Sep 2010 so she was here in UK when we got Extension.

she was here from AUG 2009 till 10-10-2010 (i.e 13 MONTHS) then she was in UK frm 15 march 2011 till 6-june-2011 ( i.e 2 1/2 months) then she was again back to uk on 19-nov-2011 till 28-aug-2012(i.e 9 months) the again she was in uk frm 12- feb-2013 till date she is here in uk.....hope she meets the criteria for ILR??

is she eligible for ILR...should i apply for dependant...plz help me
