ILR eligibility period

Hi

I got a question regarding my ILR eligibility date.

I got work permit in 2008 valid for 5 years (entry clearance visa dated 13 September 2008 to 12 September 2013), but I entered UK on 12 October 2008.
After coming to UK I have changed my visa status to Tier-1(General) issued on 16 May 2009 valid for 2 years. I have extended my tier-1 visa in November 2010 and got visa for 3 years (i.e till 28 November 2013)

Can anyone please tell me when I can apply for ILR – i.e with in 28 days before 12 September 2013 or with in 28 days before 12 October 2008.

I know that if the date of entry is within 90 days of entry clearance visa, I will be eligible for ILR based on entry clearance visa date.
But somebody was saying that because I have changed my visa status from Work permit to Tier-1 (general) that rule is not applicable and I will be eligible for ILR based on date of entry.

Please clarify.

You can apply ILR - within 28 days before 12 September 2013. I'm also similar situation like yours

tentatively last week of Aug 2013
