ILR And no job

Losing Job in August. Place closing down. My wife ILR can apply then two years are up. She's on old rules. We have all documents cohab,life in UK test etc. Is that a flat refusal because I don't have job? Will have wage for month in account for August approx £1700. Have savings £15000 wife has £1000 savings but only part time job £100 a week because looking after our baby. Small mortgage left £8000 left. As far as I am aware I won't be able to get JSA because of savings? If I pay outstanding mortgage would that be allowed? That would make co hab secure? Any thoughts please. I am British citizen...

You should meet the adequate maintenance due to savings. You can claim contribution based jsa if you have paid enough NI contributions. Contribution based jsa is not reduced by savings.

How can claim JSA it has to be joint doesn't it? Can you claim as single person and baby? I take it they divide savings by £177 so about 90 weeks + Child benefit and the little my wife earns as self employed?

Contribution based JSA is only paid as a single amount but can be 'topped-up' with income based JSA if you are a couple. However, as you have savings of £16000 you would not get any income based JSA. Moreover, as your partner is subject to immigration control you would not get any income based JSA. You don't get an amount for children. For any children you would claim child benefit and tax credits. Contribution based JSA (not affected by savings) is paid for up to 6 months then it would be income based should you be eligible. When you make a claim for JSA explain that you are a couple but your partner is subject to immigration control.

Under the old rules there's no requirement for you to be employed or have savings. You simply need to show that you are able to support yourselves financially.

Thanks for reply I was worried she would be deported back to South Africa and our 3 week old baby motherless!
