Hi guys
My case is a bit complicated... My work permit with company A started on Nov 18th 2008, and the work permit would expire on Nov 18th 2013. Now I got a new job offer with company B, who has decided to take my current work permit and transfer it to Tier 2 (general). The new job will start on Oct. 1st. If there is a gap about 2 weeks between starting of my new job and my ending of the current job, would I still be able to apply for ILR ~28 days before Nov 18th 2013? Please assume i qualify for all other requirements, such as total out of country days is less than 180. If not, when could I apply for the ILR?
Thanks a lot for your help in advance!
Best,
Hua

Are you planning to leave the UK during this time?

For ILR you only have to report absence from UK .i.e. if you leave uk
So next question is while your visa is being transferred is your continuous period for ILR considered broken.
You need to find out your "immigration status" while your visa is being transferred between sponsors. Is the transfer being done with HO involvement?
Perhaps your employer can find out for you?

Thank you dimension7!
As with regarding to "continuous period" of employment, I assume if my last day in company A is Sep 30th and my starting day in company B is Oct 1st, that would be considered as "continuous employment", correct? I was told by a friend that it allowed a maximum 28 days in between? Not sure if this is true though as I couldn't find confirmed answer in UKBA website.
My transfer is "taken over" by company B... I don't know what that means but I will find out more details. I would assume it's to do with Home Office...

Yes that is continuous. But you have said in the title of your post that you have 2 week gap.
28 days rule for
taken over is
here. It appears dependent on how well and quickly your new sponsor handles your case.
From information you have provided so far it seems there is nothing to worry.
