ILR - Long absence Offshore work assignment

Hi Guys,

I'm going to apply for ILR. But, the problem is I have 140 days long absence in a year where I was NOT paid in the UK but in India. This was with my old employer. So, I'm trying to get a letter on my absence stating a reason 'Offshore work assignment' (I wish I could say Business Travel or something else but this reason would give more probability for the letter) during that period. I deliberately have not mentioned any paid or unpaid holidays in my letter for that because I was not paid. I'm chasing up my ex-employer to issue that. What I'm wondering is even if my ex-employer was kind enough to issue that, will case worker accept that or decline my ILR? Your advice is highly appreciated.

you havent mentioned your visa category!? Is it Tier 1 or WP or both?

It is Tier 1 General.

then you dont need to be in employment for all the 5 qualifying years. employment breaks are not a problem as long as you have enough points at the time of your ILR application

Thanks for your reply mate.

Do we need to provide PBS calculator report? I don't think it's required for ILR. However, my question was surrounding the reason in the letter. Any Gurus please hep...

Less than 180 days should not be a problem even for T2 ICT.

For T1, its not an issue at all.

I'm not sure about the PBS Calculator but when you start filling up your application form, I'm sure it will be explained in the ''Documents to Attach'' checklist.
