Hi,

I am on a UK Tier 2 Work Permit (ICT) which was issued (March 2010) before 6 april 2010. I have been in the UK continuously since 3 years and would be eligible to apply for PR once I complete 5 years. My current employer is asking me to go back to India but my intention is to stay here for 2 more years and get my PR. Is it possible to transfer my current work permit to another Sponsor? I just want to stay in UK for 2 more years till I get my ILR.

Please advise!

You can't transfer your current permit but you can find a new sponsor and apply for a new permit.

Read paras 194 et al of the policy guidance.

Thanks for your Reply!

If I opt for a new sponsor, Will I still be eligible to apply for permanent residency after I complete 2 years with them. At the time of applying for PR I would have 3 years with my current sponsor and 2 years with the new sponsor?

Thanks for your valuable Advise.

Can I apply for this new workpermit while still being in UK?

Yes, and you would have to. Otherwise you will be subject to 12 month cooling off period on further T2 entry clearance.
