ILR Success - Tier 1 General -PEO Solihull

on 25 Jul 2013 My wife got ILR approved at Solihull PEO.
Thanks to everyone for their valuable feedback and this forum has indeed helped me a lot in getting her ILR approved.

Her details:
Tier 1 (General) stamped 21 July 2008
Date of entry to UK : 05 Oct 2008

Tier 1 (General) Extension:28 June 2011

Below are the absences from UK for the 5 year period from the date of

Year 5- 21-Jul-08 to 20-Jul-09 - 71 (Days outside UK)

Year 4- 21-Jul-09 to 20-Jul-10 - 61 (Days outside UK)

Year 3- 21-Jul-10 to 20-Jul-11 - 83 (Days outside UK)

Year 2- 21-Jul-11 to 20-Jul-12 - 20 (Days outside UK)

Year 1- 21-Jul-12 to 20-Jul-13 - 18 (Days outside UK)

Total 253 days outside

Her appointment was at 11:30 and the overall process from entry,security check,payment processing and biometrics took 3 hours.

Please note She is applying after 4 years and 11 months all her absences above were during Tier 1. The only documents She was asked during the appointment were:
SET(O) Form
2 Photographs
Passport and Biometric Resident Permit card
Life in the UK Test certificate
12 month payslips
12 month bank statement

She wasn't asked any questions about absences and no proofs were submitted. She did carry below documents incase the case worker asked:
5 year P60
Employment history from HMRC
Payslips during holidays
Letter from employer explaining the annual leaves taken.

She also offered an absence sheet giving the number of days outside UK, entry/exit dates and respective page numbers from the passport. Also in the bank statement She did highlight the line where her salary was credited. Whenever each document (original) was handed over to case worker She did give a photocopy as well. Case worker quite liked this and did convey her thanks.

No tension.

So the final quote is "Make your application as simple as you can. Do not make it complicated by giving lot of documents. You may keep it, but give it only when requested"

Congratulations.

Just a quick question. If the date of first entry on Tier-1 Visa is on 5th October 2008, she would still not have 5 years isn't it? Did they consider the stamped date of July 2008?
I am also in the same scenario, I got my ILR stamped on 21st sept 2008 but have entered UK on 4th October 2008 and I am not eligible to apply until after 16th sept 2013.

Hi,

I have my appointement on 30th July at solihul peo, Did your wife applicaiton was assesed before taking the payment?

Those days are gone now. Since Apr 2013, all PEOs take fees before considering your application.

Hi soul&karma,

Firsty, congratulations for the IRL.

Quick question - Did your spouse see the caseworker before the payment is made? I have now heard Solihull PEO now takes payment before looking at the application (like other PEO's)

I am assuming you got TIER 1 general stamped on 21 SEP 2008.

If the date of tier 1 stamp and date of entry is within 90 days then date of stamp is considered.

For you your continuous period qualification starts on 21 sep 2008. You can apply for ILR 28 days before 5th anniversary.

In my wife's case it is continuous for 4 years and 11 months.

It is assessed after payment is processed.

Also as per home office guidance please inform your bank before as this is a considerable amount. Most banks do security checks for processing such amounts. Just to avoid any delays it is advisable to inform your bank in advance.

Payment first
Then processing.

Also as per home office guidance please inform your bank before as this is a considerable amount. Most banks do security checks for processing such amounts. Just to avoid any delays it is advisable to inform your bank in advance

2.Did she mention in the covering letter about the absences.
