Status of child after parents on ilr

Hello,
My wife and I both applied for and successfully received ilr. After reading the forum, we decided to not apply for ilr for our son. I would like to know what would be my son's status while we apply for his passport. He is currently a dependent on my old tier 1 which is valid till may 2014. We may have to travel, and may not have time to apply for his British passport. Would he have any problems entering the country as my tier 1 has technically expired, and his staus is dependent on that. Or his staus is valid till may 2014, and he wouldn't have any issues in entering the country. As always, I will highly appreciate any advice in this regard.

Was you child born in the UK? If so, was this before or after either patent was granted ilr?

Yes, he was born In the uk before ilrwas granted.

As he is not yet British he would not be entitled to a British Passport, yet. However, he is entitled to be registered as British on form MN1 under section 1(3). You should do this now using the Nationality Chevking Service. He should be able to travel on the existing visa if necessary.
