ILR after long stay of 10 years.

hi


I came to UK 20.05.09

applied PSW in 2009

applied spouse visa in October 2011
which expires on Oct 2014.


can I apply ILR on long residence of 10 years stay category as it is about just 6 months early?

Did you apply and were granted flr(m) in October 2011? If so, are you still in a relationship with the said partner?

sorry the the first date of my coming to uk was 20.05.2005. thanks for your reply. yes I am still in relationship but I don't want to apply ILR through my partner.

Why don't you want to settle on set(m)?

You can extend your leave as a spouse with flr(m) then vary the application to set(lr) or if decided put in an application for set(lr) when you qualify.

thanks for your response.
how can I extend my leave? will home office not object that I can apply for ILR on spouse. why am I just extending leave?
or
my leave expires in October on spouse visa (2 years). I applied in old law. my ten years are completed in april 2015. so can I apply ILR in October 2014 on the basis of ten years?

So far as you meet the requirements you can extend though I'm not sure what's going on re: set(m), if your relationship is not subsisting then flr(m) would not work.

For set(lr) you can apply from 28 days before your 10 years is complete.
