Hi,

When can I apply for ILR?

Apr 2007: Came to UK on Intra Company Transfer
Nov 2007: Applied for HSMP approval
Dec 2007: Got HSMP approval letter
Apr 2008: Got Tier 1 General (HSMP was changed to Tier 1)
Jun 2009: Went back to India
:
Oct 2010: Came back to UK (after 16 months) on previously valid Tier 1
Mar 2011: Applied for Tier 1 extension
Oct 2011: Got Tier 1 extension approval
:
Living in UK
:
Aug 2013: Applied for Tier 1 extension (valid until Oct-2013)
:
May 2015: Can I apply ILR here? assuming I can include 6 months of my time outside UK (Jun-2010 to Oct 2010) which is allowed yearly
:
Oct 2015: OR should I apply ILR here?

Any other suggestion please?

Thanks a ton!

You can apply in/after May 2015(If it satisfies <=180 days rule) .

Incorrect. Continuous residence has broken, you can apply 28 days before Oct 2015.

Continuous residence has broken if qualifying period is based on any date before may 2010 considering <=180 days rule . If it is calculated from may 2010 it would statisfy <=180 days rule . No ?

I can see some weight in argument from dk2011 and that's my assumption as well but I am no expert.

Seeking further inputs from experts and gurus, thanks!
