Hi,

As per the changes in the KOL and life Requirement that will come into place after 28th October 2013, the dependants also need to
-- pass the life in the UK test; and
-- having a speaking and listening qualification in English at B1 CEFR or higher, or its equivalent.

For the second requirement if the dependent can show a degree that is taught in English like the main applicant does in case of Tier 1/2 visa for English language, would that suffice. Or the dependent need to take this ESOL exams to prove the English language ability.

Can seniors please advise?

A degree that is comparable as per NARIC and taught in English should suffice.

I guess if I can get 10 points on the Point based calculator in English Language Qualification for my dependent's qualification then it would mean that it is acceptable for KOL requirement. And in which case I can just carry the degree as a proof as you do for Tier 1/2 application.

Is that correct?

It's not been confirmed yet, but I would presume so. Ultimately a NARIC statement of comparability and proof it was taught in English is what counts but yes the points calculator acts in a similar way.

It may be acceptable for the B1 CEFR English language requirement (the second part), but not for KOL life in the UK test (the first part).

However I was checking the Set(O) and Set(M) forms but currently there is no option to tick that you can satisfy the English requirement if you have a degree taught in English. Even before 28 Oct2013 the dependents had to fulfill one of the two options i.e. to either PASS life in UK or pass a course in English and citizenship.

In Tier 2 application form there is provision to tick the English Language requirement if you have a degree taught in English.

So what do you fill in the SET(O) or Set(M) form currently if you are appying as a dependent and you are satisfying the KOL requirement by having a degree taught in English.

Could someone who has faced a similar situation please comment?

Your first post concerned applications after 28-oct-2013 now you've jumped to current. Currently the requirement for settlement is KOLL which is satisfied with the Life in UK test or ESOL with citizenship. After 28-oct-2013 this is still required in addition to the B1 requirement.

I got a bit confused, I thought that the current requirement is "Life in UK test or ESOL" instead of "Life in UK test or ESOL with citizenship". Thanks for clarification.
