Post by Ish51 » Thu Aug 29, 2013 8:09 pm

My wife got dependent visa (from home country) on 1st of July 2012 of Tier-1 General main applicant. Before she was on student, PSW, Tier-1 general. Can she apply for ILR / PBS dependent / FLRM.

Are you now settled granted ILR? If so, under what category, long residence or PBS?

Since when have you two been living together in the UK?

From 2007 onward... till date. Wife went to home country for 15 days to get a dependent visa in July 2012.

If you can prove evidence of cohabitation for the 2 years preceding the settlement application, then your wife may apply for settlement at the same time as you.

But don't be surprised if the application is refused and in such case do appeal.
If attending a PEO, a caseworker might tell you that your wife does not qualify and may ask you to to apply for self (you) only. In such case, tell the caseworker that you will not be excluding her as dependant, willing to pay for the dependant and willing to accept that she will be formally refused (a formal refusal will lead to a right of appeal, if you withdraw her application you will have no legal recourse).

When is your wife's current leave expire?
