Can anyone advise me please on the following question:

I've received my Tier1 in 2009 and planning to apply for ILR next year.

The new rules are saying that from October 2013 everyone will need to satisfy the new English language requirements.

I've proven my English level back in 2009 by passing a TOEFL test, which in principle has 2 years validity. I was not required to do any English for Tier 1 extension in 2012, although in principle that test certificate has already expired (in the forms there was an option "English language requirement was met in the previous application").

Can I safely go for ILR PEO and do the same, i.e. say that my English was already proven when I applied for the first entry as Tier 1 general migrant?

Thanks for your response but I don't see an answer there. Apparently it suggests that, in a general case, Tier 1 migrants who were main applicants initially, are NOT exempt from the requirement? (even though they had to prove English of a much higher level for their first application)

If you received points for your degree during PBS applications that should suffice.
