Am I eligible for ILR?

My visa status is as follows

Tier 1 (G) issued: 08 November 2008
Date of Entry into the UK: 10 December 2008
Renewal of Tier 1(G): October 2011
Renewal validity: 28 November 2013

I would like to apply for ILR on the basis of 5 year stay in the UK in November 2013, however I have been out of the UK for 188 days in total over the last 5 years. 8 days over the limit.

In the initial 3 months of my Tier 1 (G) I was travelling between the UK and the country I previously lived in to wrap up my life there due to which I was out of the UK for about on 3 occasions for 15, 16 and 37 days (68 days in total). The remaining 120 days I have spent out of the UK were on annual leave.

Am I eligible to apply as I am over 180 day limit? If so, can you please let me know what documentation I need to provide along with the application? I have my current contract which shows the that I am entitled to 29 days annual leave per year for the job I have been in since April 2013. However, I do not have or will be able to provide addition documentation from my previous employers as they are not willing to give any nor do I have a contract. What should I do?


I have found this forum to be very helpful and would appreciate advice from experts on here.

No, I do not have a 180 day absence in any 12 month period. So am I ok?

In the form the applicant is asked to list all absence and select type of evidence provided with application. Do I need to submit any documentation related to absences under 180 days?
