Hi,

I am due to apply fr my ILR in Aug 2014. My wife is British, but I am applying using SET(O) form. The question I have is she just joined University. I am wondering if I apply for student discount on council tax. Is that classed as benefit? I am happy to pay the full amount if that effects my application next year. As the times bit hard discount will be good but I dont want to risk my application.

Thanks in advance.

Council Tax discounts are not classed as public funds as long as you are not claiming Council Tax Support (previously called Council Tax Benefit)...
If you and your wife are the only two adults in your household and your wife becomes a full time student then you will get 25% 'Disregarded Person Discount' and will pay the 75% of your annual council tax. Be assured such a discount is not a public fund and will not affect your ILR application - as long as such discount is not falsely claimed.

As stated above, a Council Tax Discount is not a public fund for the purpose of immigration, thus not a council tax benefit nor a reduction under the new regulations.
