I need a small clarification on the salary threshold's used for a work permit holder (based on annual pay) on applying for ILR.

if the pay is based on a lower number of hours (ie 37 a week) and is slightly lower than the minimum pay as stated in the Codes of Practice which is based on a higher number of hours (ie 39 a week in my case), would UKBA do the calculation to pro rate the actual pay against the COP pay.

thanks in advance...

They are only interested in 39 hours salary so if your salary is based on 37.5 hours put the figures accordingly and they will calculate the 39 hours equivalent and compare it to the COP rate.
