New SET/ILR Application Forms To Be Introduced 28/10/13

UKBA is publishing new versions of the following application forms for use on or after 28 October 2013:

SET(BUS) - settlement (overseas business representative or retired person of independent means)
SET(DV) - settlement (victims of domestic violence)
SET(F) - settlement (children of British citizens or people settled in the UK)
SET (LR) - settlement (long residence in the UK)
SET(M) - settlement (marriage)
SET(O) - settlement (other)
Guidance notes for the SET(BUS), SET(LR), SET(M) and SET(O).

All these forms are for use by applicants who are already in the UK.

You should use the new forms if you apply on or after 28 October 2013. However, UKBA will continue to accept applications made on previous versions of these forms up to and including 18 November 2013.

If your application is received on or after 28 October 2013 you will need to meet the revised Knowledge of Language and Life in the UK requirements, and send evidence of that.

Didnt see this until now. Sent wife's ILR application this morning 26th oct with no evidence of passing b1 english requirement. UKBA will receive application on 28 oct. Looks like she will be refused ILR on basis of not meeting new english requirement :/

No she will not be refused because:

1. the date of post is the date of application for immigration applications so as long as she had LIUK/ESOL with citizenship she will meet KoLL.

2. You can use the old forms for 21 days after 28-oct-2013.

Thanks Amber. That sentence about them receiving the form on 28 Oct kind of threw me. I do find UKBA wording and rules very confusing.

As for the second point, it seems the b1 requirement doesn't truly come into full effect until 19th Nov

in this paragraph what does mean from (life in uk requirements) which i shade in green colour. Is that signalling to new life in uk test :o :o
