Apply for my wife and son

Dear Damanisshallo
I got my ILR on 14 Oct 2013 as a 10 years route Student Visa. Now I would like to apply for my wife and son who both came UK on April 2006(7 years in UK).Can you please tell me which application form do they have to fill, their recent visa ( Tier 4 student dependent ) expire on April/2014.My wife got ESOL level 2 certificate in speaking and listening.
1.Does she have to do again give English test because of new rule?
2.Do I have to work before apply for my wife and son?
3.Do I have to earn 22,000 per annum.?

If she has been a PBS dep since before July 2012, she will need to apply for FLR(M) and then when this is granted SET(M) by virtue of immigration rule 287(a)(i)(d). I would do this via a PEO ASAP. For FLR(M) the English requirement is A1 and for SET(M) it is B1 plus LIUK. There is no specific financial requirement, rather, adequate maintenance and accommodation.

I have got my ILR on basis of long residency in UK last year Nov 2013.But now I would like to apply for my wife and son as my ILR dependent,who both came UK in 2006 as my dependent.Can anyone please answer as my below question please?
1. Which form they have to fill?
2. I am working as a consultant since Nov 2013.DO I have to include all my 3 months payslip.
3. My wife got only ESOL city and guild certificate B2,but don't have Life in UK certificate.Can he apply with ESOL B2 certificate only?
4. How much of money do I have to show in Bank.I just started to work after my ILR got in Nov 2013 and my wife and son Visa is expiring in April 2014.Can she apply from PEO in B2.

Thanks Amber,if they apply by post how long does it take for their FLRM visa to get and can my wife and son(11 years) old can apply a child benefit and other benefit.

Same day decision at a PEO. As you have ILR, you can claim child benefit and jointly claim tax credits, with your spouse.

Dear thanks for your reply.But I asked my solicitor,they said untill my wife and son get ILR dependent,they should not apply any public benefit,Is this right.Also they said if they apply benefit now in their my previous student dependent visa,there might be problem when they apply my ILR dependent(FLRM) form?Can you please clarify more detail?

Your solicitor is talking rubbish. You can claim child benefit in your name and tax credits in joint names.

One question is that my wife and son is going to apply a FLR(M) form as my ILR dependent at PEO,but on FLR(M) form I saw in PEO office form cost £953 for my wife but what can I do for my son(10 Years old).Can I include with my wife application £1761 with one dependent or also my son and my wife they both have to pay £953rach(Total £1906).

Dear Ambar,
I am planning to fill my wife and son FLRM application but found some question are bit confused can you please help me?
On FLRM application page no:8 Question 2.2 asked Is this the first time you have applied for a visa or extention of stay in one of the above categories(including previous leave granted as a fiance(e) or proposed civil partner) with your current sponsor? YES NO?????My question which one shall I tick????

Page 10 Question 3.17 Has your sponsor previously been sponsored as a partner of a settled person?

Page 18 Section 7A- Financial Requirement ??????Do my wife and son have to fill this financail details???

Dear Amber,

Thanks for your help.On 11 Feb my wife and son FLRM application form was approved by UKBA Croydon premium service.And yesterday @ 16:00 we recevied my wife and son bio card valid for 2016.But both of their card we found,NO PUBLIC FUND.

(1)I was wondering to apply Child benefit for my son 11 years old and tax credit.Can I apply child benfit for him.If I apply public funds now will there be problem for my son ILR apllication in future.I am very much confused.

(2) And one more question,I got my ILR in 13/Oct/2013,When can I apply British Passport?

Child benefit in your names, tax credits in joint. Naturalise one year after ILR subject to meeting the other standard requirements.
