ILR - Spouse

Hi,

I am currently on 2 years spouse visa, which is ending soon and I want to apply for ILR. I have been married for 3 years but switched to spouse visa after one year of marriage, the problem I have is that my wife has not been in the country for last six months, she has been working abroad on a short term temporary contract. She has visited UK once in this period and I have visited her 3 times in last six months, not exceeding the limit of 90 days abroad. She will be in the country when I apply for ILR.

In this situation do I qualify for the ILR? I would appreciate any help in this matter.

You should be ok as a temporary absence for employment should be acceptable. However, you should supply evidence that a subsisting relationship has existed throughout as well as cohabitation proof.
