Applying ILR on 10 yr rule while waiting decision on appeal

Experts and Gurus please help and guide..
My 10 year legal stay will finish in Dec 2014, and My current VISA expires in April 2014.
If I put my VISA for extension either on study basis or Business entrepreneur in Aprpil 2014 and in case (May God not do it) ir gets refused and I get appeal and appeal takes long time and mean time I finish my 10 years legal stay, then can I differ my application to ILR or i have to wait for the outcome of my appeal ?
and in case appeal its rejected can I still apply 10 year rule ??
And i get appeal and appeal date dosent come and mean time 10 years I complete then can i differ my application ?
