Tier 2 - ILR elgibilty

Hi

Can someone help me please... I applied for Tier 2 visa in March 2009, this was rejected as CW didnt gave me points for SOC claiming that my job title is not as per industry standards. I appealed against this decision and this was successful in July. HO and same CW contacted me asking me to return my passport, I received stamped visa after few days and was stamped in August, but my visa was back dated to March and visa issued until March 2012

Since than I have got another extension for 3 years until 2016 for Tier 2 visa.

Can someone advise me when is the earliest I can apply for ILR, will home office consider my appeal period since this was mistake on Case worker's end.

Any advise will be much appreciated!!

You will be eligible to apply for ILR 28 days before your qualifying period.

TBH, your visa was backdated, so you don't even have to bother if you were covered under Section 3C/3D. If you were'nt backdated then you'd have been covered by 3C (If your current visa then was expired whilst your application was awaiting consideration) or 3D (If you had an outstanding appeal).

But, I don't see any complications in your case.

Hi thanks for your reply, but when will my qualifying period start as visa was stamped August 09 until march 12 ?
