Hi All,

I am Tier 1 visa holder and can experts advise on my eligibility to apply for ILR. Below are the EC dates.

Tier 1 ( General) - Visa started on 10-Dec-2009 valid for 3 years
First Entry to UK - 03-Mar-2010 (83 days from date of stamping)
Applied for extension in Dec 2012
Visa Expiry on 10 Dec 2014

Outside UK from 03-Mar-2010 till date is around 95 days(which is less than 180 days).

As far as I am aware, I can apply for ILR 28 days before 10 Dec 2014 and I think the 90 days consession applies to me. Can Moderators and Guru's advise on this please?

Thanks in advance,
Aani

Yes,
calculating continuous period in the UK @ Page 21 wrote:The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period, as long as it does not exceed 90 days. This can occur if the applicant is delayed travelling to the UK. Provided the period of delay does not exceed 90 days, it will not be counted as an absence.

Hi Aani,

Provided an applicant enters the UK within 90 days of their entry clearance date, they can count the period of delayed entry within the 5 year continuous period.

All the best!
