Wife visa switch from 'Tier 2 ICT' - husband having ILR

Hello All,

I have an ILR visa, and my wife holds Tier 2 ICT visa and currently working in UK. Her Visa is valid only for one year and also falls under cool of period.

I believe I can apply to switch my wife's visa from 'Tier 2 ICT' to 'Tier 1 dependent'. UKBA wont give an ILR as she needs to spend more than 3 years in UK, but I read somewhere that they can provide a Tier 1 dependent.

Can you let me know if my understanding is correct, or let me know if there is anything else possible?

Thanks
mathewp

If she switches it will be a further 5 years.

I don't think that she may switch to PBS dependant, if you are now an ILR holder and she isn't currently your dependant. She may apply for FLR(M), subject to meeting the requirements.

Moreover, Lucapooka is correct.
