ILR 10 years and Gap of 5 months

Hi every one ,
i need your guide please advice me what to do .

1) i entered in UK oct 2004 as a student
2) psw visa was rejected on bases of shortage of money in statement in 2008 . went through appeal process but again it was rejected so on july 2008 i left uk to apply for PSW from Home country that time i have one year after completing my master degree i re-apply for psw and
2) got psw visa in nov 2009.
3) came back in dec 2010 .
4) got HSMP in 2011
now applying HSMP extention 2013

my question is Am i completing my 10 ILR 0n 0ct 2014 please guide me regarding this issue .

if you came back dec 2010 then you have more 12months break in continuous residence. you are allowed upto six month. unless you meant dec 2009.

As you left UK after unsuccessful appeal and got new visa from home country, your 10 years continues leave broken down and you can not qualify for 10 years long residency, according to rules you must have valid visa at the time of departure and return (visa categories could be different).
