Hi,

I have query about the qualification of ILR.

Applied for Tier 1 (G) (incountry application - UK) on 31 March 2010. Before that I was on Post Study Work.

Tier 1 (G) Initial: 15 April 2010 - 15 April 2013 (3 years)

I applied for Tier Extension (incountry application - UK) on : 11 March 2013

Tier 1 (G) Extension: 11 March 2013 - 11 March 2015 (2 Years)

Now the total duration on Tier 1(G) is: 4 years, 10 months, 24 days.

Do I qualify for ILR without another Tier 1 Extension?

I would suggest to apply by post (if you can) before 11 March , 2015

* I posted the initial Tier 1 (G) application on 31 March 2010. I used 31 March 2010 as start time on Tier 1 Extension application which was ok with the case worker. Shouldn't I start calculating time for ILR application form same date(31 March 2010) instead of when the actual visa was given (15 April 2010)?

And

* I assume Total time for qualification is 5 years minus 28 days (as we can apply 28 days in advance).

I think your timer starts from your visa data as it is in-country application.

I think your timer starts from your visa data as it is in-country application.

I am confused as PBS calculator help for Date of application says:

Date of application
For applications made from inside the UK this will be taken to be:
*where the application form was sent by post, the date of posting; or
*where the application form was sent by courier, the date on which it was delivered to the UK Border Agency or the Home Office; or
*where the application form was submitted in person at a Public Enquiry Office, the date on which the application and associated payment was accepted.

For applications made from outside the United Kingdom this will be taken to be:
*the date that the fee associated with the application was paid. This means *the date shown on your payment receipt, which depends on how you paid for your visa application, for example, at a British Diplomatic Post, visa application centre or online.

This is to establish which rules will be applicable for age/qualification etc.

Thanks for reply.

I called to home office today and discussed my case with representative .I also mentioned that when i was granted the Tier 1 (G) extension (via personal appointment) case worker told me that my extension application is successful and at the end of this extension i will be qualified for ILR.
Today representative took my application reference number for Tier 1 (G) extension and after a long wait he came back to me saying that I will qualify for ILR without futher Tier 1(G) extension as I will complete 5 years in March 2015. On my further query about how he calculated five years. He mentioned that It is simple
Initial visa was granted for 3 Years (15 April 2010 - 15 April 2013) and
Extension is granted for 2 Years (11 March 2013 - 11 March 2015)

Which make 5 years and I should not count days from 15 April 2010 to 11 March 2015 directly but duration of the visa granted. Also, he mentioned that I can apply within 28 days before my current visa expires.

I am in a similar situation but confused ... not sure what to say or do.

Initial Tier -1 Start date: 2nd Feb 2009
Arrived in UK: 30th May 2009 (118 days late)
Extended Tier -1: 14th March 2012
Tier -1 Expiry: 14th March 2014

Eligible for ILR on 30th May -28 days = 1st May 2014

There is this gap of roughly 1.5 months and hence I am not sure whether to extend or apply for ILR

I have a similar problem. Interestingly, you will be applying before me. I have been reading some posting on this similar problem. You can check the post of ZA or Zwadi (Tue Jun 18, 2013 11:55 am Post subject: Re: ILR short of 2.5 months). There was another posting on (Posted: Wed Jun 19, 2013 7:20 am).

If you can search for these names, go2khurram and Willco (Got my approval letter today), both applied by post and they got their ILR. Read their stories and advise to those in similar situation.I would have referred you to the direct links on all the above, but i do not know how to go about it. I only copied the cases out and pasted it on ms words.

These posting bears relevance to our cases. Read through and let me have your opinion on them.

Apply by post for an extension before leave expires then vary to SET(O) on 01-May-2014.
