I have gone through the FAQs and then guidance of Set O form etc however I am worried on few things in my application.
My Details:
HSMP granted 11 March 2008
Entered UK 26 June 2008 (here missed the 90 day concession)
Left UK on account of my dad's ill health after 10 days
Reentered UK 1nov 2008 (exceeded 180 days here )
Extended /Tier 1 switch 2010 to 2013
Extended tier 1 2013 to april 2015
If I appply ILR in jan 2014 and calculating the 5 years as per the guidance I believe I meet the qualifying criteria of 5 years continous leave to remain . Is this correct please?

In the form there is no specific section to fill in only
the qualifying years. I can mention all my absences and reasons. However, the evidence for going beyond 180 days owing to my dads illness maybe difficult as it was in 2008.This absence again does not fall in the continuous 5 year qualifying period.
Will a covering letter be enough. Please advise.

Q2. I was made redundant and between Dec27 '2009 to Jan 13 2010 I was away from UK .This is the only unpaid absence in the qualifying period of ILR. Will this affect my ILR application ?

I am trying to apply for the ILR in Jan/ Feb'14 at PEO as our baby is due in April '14.

Lets say you want to apply on January 27, 2014

From Monday, January 27, 2014
Subtracted 4 years, 11 months, 2 days

Result: Wednesday, February 25, 2009

So from January 27, 2014, counting backwards in 12 months period, your absences should not exceed 180 days in each 12 month period.

Yes from 1'Nov'2008 till the time of my ILR application my absence would not be > 180 days in any calendar year.

In the form do I still have to provide evidences for my absences between the below dates please?

Mar'11'2008 to 27'June'2008

06 June 2008 to 01'Nov'2008

Please advise.

Hi Vijay,

I think you should be OK, and what UKBALovestory said is good; as the one absence of >180 days is outside your 5 year period.

But in the SET O form,

In Section 6, Page 14, you would still have to mention all the absences, even if they are <180 days.
In Section 7, Page 19, you would have to mention only those which are >6 months.

So, you should still mention all your absences in your 5 year period in section 6. This is the way i am doing too for my application (i don't have any absences >180 days, i still am filling section 6).

Not sure if you need a letter for the absences <180 days, but i think it is safe to keep it handy, because on Page 14 question 6.3 asks for it.

I ask the experienced members to clarify on this point???????

Year 1 20 Jan 2014 to 21 Jan 2013 Out of UK 23 days
Year2 20 Jan 2013 to 21 Jan 2012 Out of UK 10
Year3 20 Jan 2012 to 21 Jan 2011 Out of UK 25
Year4 20 Jan 2011 to 21 Jan 2010 Out of UK 40
Year5 20 Jan 2010 to 21 Jan 2009 Out of UK 40

As I first entered on June 27 2008 left in 10 days and returned in Nov 2008 . What should I mention for how long you have stayed in UK 7.11 of SET O . Should I calculate number of days in UK and convert into months please?

My wife entered UK on 28'Dec'2011 so she is entitled for ILR by Jan as she completes 2 years is that correct please ?

Can you please clarify the query below? I got an appointment booked on 21st.

Considering my absences what should I fill in section

6.1 : I believe this the first date I entered UK on my HSMP . Please confirm.

6.2 : I believe I have to mention all absences till date from I entered UK . Please confirm

7.11: Shall I convert the days from date of entry till date into years and months ? I can mention one instance for more than 6 months however this does not fall in the continous qualifying period.

Kindly advise on the above . Appreciate your help on the same in advance.

How did your appointment go? What you did for your unpaid absences?

Hi ,

Our Application was successful. The unpaid absences would not be a concern .

As long as you do not have absences beyond 180 days you need not worry. However to be on safe side I have submitted medical certificate for that period.
