Baby to be born in UK to ILR Indian parents

Hello members,

We are Indian parents holding ILR which we got recently.
Initially i was on dependent visa of my husband who was holding a work permit. Now recently both got ILR.
We are going to have baby this April. We are planning to travel to India with baby soon after birth to have the christening done, so within 2 months/ by July atleast or as soon as the passport of baby is ready. Most of our family is back in India..
So our question was, do we apply for british or Indian passport for the baby; If so which is the easiest way or less complicated way and how long (weeks/months) does the whole process take to complete before we could travel. Preferably would like to apply in person rather than post.
Our main aim is to go to India as soon after baby's birth either with Indian or british passport or OCI for travel along with us, whichever is convenient. Can anyone help in this matter, open for suggestions.

if either of the parents got ILR then baby can be registered as British by birth. It should take 1 month for registration and same time for getting British passport. Baby cannot get OCI until the parents are British. So in your case, you will have to get visa for India if you register baby as British and get her British passport.

I am not sure how much it is advisable to get Indian passport for baby and then get UK visa or ILR on it so that baby can return back to UK without any problem. But if you can wait for 2-3 months after baby birth, I would suggest get British passport and get Indian visa done on it to go to India.

baby will be british by birth as born in uk to parents who are settled. apply directly for british passport using fast track and it take a few days

So British passport is better option of baby born in UK as suggested.
So will the whole process of registration of birth & applying of passport take approx 1 month all together or 1 month each, or both can be done simultaneously?

Considering we get British passport for baby, so then we need to go HCI London to apply for what type of visa to travel for India for the baby? Is it PIO or OCI or some other visa ?

In future will that Indian visa applied now be valid for travel to India considering that the baby will travel with us every year to India for short holidays. Do we apply for visa all the time for the baby when baby travels with us to India considering we stay on ILR Indian passport. Will there be multiple entry visa or dependent visa for the baby?

We as parents prefer ourselves to remain on ILR Indian passport and dont mind the child to be on British passport.

Can anyone suggest the best way..

Once the baby is born and the birth registered at the Registry office (local Council), you can apply directly for a passport and you can use the fast track service which costs a little bit more than the normal fee. Normal waiting times are about 3 weeks and fast track is 3-5 days.

Please note that you DO NOT have to do Registration as British Citizen on form MN1 if the child is born AFTER you are granted ILR, apply for passport directly.

To be frank, by asking the time it takes, I want to decide how long it will take from birth registration to applying brit passport to getting indian visa, just to decide the time fram all this will require. (considering the fast track service/ going in person)

We as parents prefer ourselves to remain on ILR Indian passport and dont mind the child to be on British passport.

Hi All,

We are in the same situation.
Both of us are on ILR and baby was born in April after we received ILR. We are applying for his British passport now.

Would like to know if we wish to travel with the baby to India shortly, what is the best to apply - PIO , OCI or Indian visa for him ?

Hi,

That is the case of Baby born after parents got ILR.
What should one do, if Baby born before parents ILR for example baby born in Mar-2014 and parents ILR due in next year or after a couple of months?

It depends on how long you are willing to wait to travel. The child will qualify for OCI, but that visa can take 6 weeks to 6 months. If you don't want to wait that long and deal with the uncertainty, you can get the child a visitor visa. This will be valid for 6 months (normally).

The OCI visa stands for Overseas Citizen of India. It is a lifetime visa with unrestricted travel and residency limits. But it takes time as I mentioned. A visitor visa would likely only be valid for 6 months. You would probably be able to get that visa in a week.

Registration of birth is pretty much as quick as you want it to be. Just call and make an appointment. The passport will be about 2-3 weeks. The visa another week. If you can manage everything back-to-back, 4-5 weeks total.
