10 Years Long Residence - Few days short

Hi, I have a question, let's say if 10 years completes on 18 February 2014 and current leave to remain is valid until 10 January 2014. Can we apply for ILR in such case?

I would really appreciate if you guys can post your thoughts on this?

You should apply for an extension before current leave expires, by post, then vary to SET(LR) from 28 days before 18-Feb-2014 to avoid any issues.

Some options perhaps.

You worried about 39 days trust me you not gona heard from them at least 5 months, just make sure your delay your biometrics and apply before your leave expire, you will be covered by 3C leave.

I am exactly in the same boat, short of 40 days for my ILR on the basis of long residence. Initially I was more incline towards extension and then vary it to Set (LR) but recently changed my mind because of few successful early applications I came across in this forum. However do some research as in the end its your call,

Okay, so the best advice is to apply on 10th January for extension, and then on 18th January sent a letter to home office to vary the application to ILR. Also, are the fees for extension of Tier 1 visas and ILR same?

PS: I gave examples of 2014, but the actual dates are in 2017, I just wanted to gather together some advice :)
