ILR - SET(M) - Advice on working overseas!

Hi Guys,

Some advice please....

My wife was granted a Spouse Visa and came to UK on Feb 2012. In November 2012 I was offered an overseas job, which I took up. I had a vacation back to the UK in March 2013 when our daughter was born. Thereafter my wife and daughter spent a month with me overseas. Subsequently I have visited the UK for vacations. Key thing is that we have spent some time apart since her arrival to the UK.

I need to apply for her ILR approx. end of March 2014.

My question is that as I am not present in the UK (due to employment), will that count against the application. Additionally I also got my wife a residency visa on her passport when she came to visit me. I am concerned that the application could be rejected as we are not living together and I am employed overseas.

Please can you offer any advice.

It shouldn't provided you have evidence of a subsisting relationship.

Hi Amber thanks for your re-assuring words.

However, i understand that the sponsor (i.e. British National, me in this case) should be present in the UK. That is where my concern/nervousness lies.

Would this be considered a straight forward case? Im inclined just to pay the additional amount and get it done in person. Providing the subsisting relationship should not be too much of an issue. In fact finance/paperwork is the least of my concerns.

Yes, you should attend a PEO appointment together.
