Hi

Please advice me based on my situation.

My husband is self employed and I am working as temporary employee. My husband started working as director of his own limited company from 20th January 2014. Till 17th jan 2014 he worked as permanent employee. We both hold ILR since April 2013. Our son who is 4 years is currently in India and we want to apply for his ilr from India. He earlier had PBS dependent leave to remain in uk which expires on 28th January. I know that child's visa is void after we got ilr. My husband will be sponsoring child's ILR application but as I said my husband is self employed from last week. What all documents do we need to send to India to apply for child's ilr.

We already have sent below docs and wanted to apply for child's ilr from India the coming week
1) husbands earlier 6 months payslip and bank statement
2) current house tenancy agreement and council tax documents
3) both parents passport and ilr copies.
4) mothers(my selfs) 3 month payslip and bank statement as I have only worked for last 3 months.

We have filled vaf4 and vaf4 annex 1. What other docs to send as we have to mention sponsor as self employed from 20th January 2014. At the moment the sponsor as company formation docs, business bank account and contract between his own limited company and his customer. No money in business account yet as he started working last week. Can we apply for child's ilr or should we wait till he gets money in his business bank account. He has £10k in his personal account and I have £6k in my bank account.

Please help me with your valuable advice.

Thanks
Shwetha

Where was the son born?
I know that child's visa is void after we got ilr.
How? Why?

How you and your husband qualified for ILR? (Ten years basis or on Tier 1 basis? or...?)

Thanks for replying.

My Husband came to UK in April 2008 on Tier 2 Intra company transfer from India to UK. He worked for same company for 5 years and qualified for ILR.

I came to UK in 2009 and had child in 2010 in India. Son was born in India. Son was in UK from Nov 2010 till August 2012. I qualified for ILR as I stayed 4 years as Dependend in UK.

In August 2012 I wanted to start work in UK and so thought will get some training in India. In August 2012 I went to India with my son and completed training in India for 6 months. After I completed my training I came back alone to UK in Feb 2013. We qualified for ILR in April 2013 and we both Husband and wife applied for ILR and got the ILR. But Son was still in India. He was holding PBS Dependent Leave to Remain which was valid till 28 January 2014.

Now we both are working and wanted to bring my son back to UK.

Please guide me in this situation.

Thanks,
Shwetha
