ILR - PBS Dependant (Wife): Immigration and Personal History

I am a PBS dependant [Wife of a Tier 1 (General) migrant, who is now on ILR]. I believe we will have to use SET (O) for my ILR application. Is SET(O) the correct form?

Section 6 – Immigration History:
6.1 When did you first enter UK? I first came to UK in 2009, but when I went to India in 2010, I lost my passport and then eventually had to stay there for an extended period to get replacement passport and visa. After this event, I again entered UK in Jan 2012 as dependant of Tier 1 (General) migrant. Can I enter Jan 2012 as the answer for the question 6.1 as this is the period on which my ILR application will be based for the purpose of 2 year of continuous cohabitation even though I first entered UK in 2009?

Section 7 – Personal History:
7.11 How long have you lived in UK? I believe I will have to enter the period since 2009 and provide reason for the long absence. Is that right?

Please kindly help me with the above question.

Yes if your wife has settled as a PBS applicant and you have satisfied the qualifying period, SET(O) is correct. B1 English and LIUK required.

Hi,

Thank you for your reply and for pointing out about B1 English and LIUK requirement. For English language requirement, I am planning to use my degree and a printout from UKBA points calculator to prove that I have scored points for english language requirement. Is this sufficient or do I have to get statement of comparability and English language assessment from UK NARIC?

Regarding LIUK, I took the test in Sep 2012, Can I still use that?

Just to correct, my husband is the one who is settled as PBS applicant. Could you please also answer to my other questions, given in my initial post regarding section 6 and 7.

Yes you are right about 6 and 7.

Yes a print out of points awarded (10 for English skills) should suffice with degree certificate. LIUK can continue to be used.

Hello Amber,

Many thanks for your reply.

I have 2 more questions. Could you please help with me with your answer for the following questions?

Section 5 – Your Home and Finances:
5.2 How much do you pay each month’? My husband pays all the rent. So can I enter £0 for this question?
5.6 Source and level of income to maintain you and any dependants. I believe I need to include earnings from my husband’s employment as I currently do not work?

Section 10 – Biometric Residence Permits:
Give details when and where your fingerprints were taken? I have given my fingerprints twice. Once in India as part of my entry clearance visa and once in UK as part of my extension visa. Do I have to provide details of these two instances as an answer for this question or just the last one i.e. the one given in UK?

The answer would be yes, and write in how much you pay not £0.

5.6 Source and level of income to maintain you and any dependants. I believe I need to include earnings from my husband’s employment as I currently do not work?

Yes, you include both and supply the last 3 months bank statements and wage slips.

Just the uk will be fine.

Hello Amber,

I got a question regarding payment details page in form SET(O). As the payment is made online as part of the appointment booking, I believe we don't have to fill the entire payment details section of the application form. Please correct me if I am wrong.
