Do I qualify for ILR or do I have to extend Tier 1

Hi all,

Will appreciate all the help I can get. I have two key questions:

1. ILR QUALIFICATION

I successfully got my first Tier 1 visa 1st May 2009, expiring 1st May 2012. However, I entered the UK on the 10th of August 2009 (3 months and 9 days late) as my brother had some medical slip up related to his autism care.

I renewed my Tier 1 in 2012 for an additional 2 years with biometrics, and this resulted in my extended visa given a new expiry date of the 6th of July 2014.

I am still short of 34 days to make up 5 years from date of entry in 2009.

And I will need my passport to travel back to Singapore on July the 12th for my wedding. So putting in a Tier 1 extension and then retracting it for an ILR will not be possible.

Should I, a) Extend my Tier 1 again or b) Book a PEO on the last week of July?

2. 180 DAYS LEAVE

I am in slight confusion of this 180 day leave rule. Is it the total number of days out of the UK over the five year period < or = 180?

I spent 65 days in Sydney for work while still on UK payroll and NI contributions. And therefore my total number of days out of the UK are into the 200's. Including my standard annual holiday leave. I have not been unemployed throughout the entire 4 and a half years (to date) of being in the UK.

I will appreciate all the help I can get. Thanks!

180 days is for each qualifying year. So , you are fine.
If you can't vary your application or apply ILR in post then you need another extension.
